  • Filing the Application:

    Once you've ensured the uniqueness of your trademark, you can proceed with the application filing. You can file your trademark application online through the official website of the Indian Trademark Office (https://ipindiaonline.gov.in/).
  • Classification:

    Trademarks are categorized into different classes based on the goods or services they represent. You need to specify the class or classes relevant to your trademark during the application process.
  • Examination:

    After filing the application, it undergoes a formal examination by the Trademark Office. The examiner checks for compliance with the relevant laws and regulations. If there are any objections or deficiencies, the applicant is usually given an opportunity to address them.
  • Publication:

    If the application meets all requirements, it is published in the Trademark Journal. This publication allows third parties to oppose the registration of the trademark within a specified period (usually 4 months) from the date of publication.
  • Opposition Proceedings:

    During the opposition period, any interested party may file a notice of opposition if they believe they would be harmed by the registration of the trademark. If an opposition is filed, the Trademark Office will initiate opposition proceedings to resolve the dispute.
  • Registration:

    If no opposition is filed, or if the opposition is unsuccessful, the trademark proceeds to registration. The applicant will receive a registration certificate, and the trademark will be protected for a period of 10 years, renewable indefinitely.
